wage and hour violations

You are entitled to be paid a minimum of $12.00 per hour in Florida, time and a half for overtime hours worked as an non-exempt employee, and tips for tipped employees. If your employer is not paying you as required, you can file a claim to recover your stolen wages.

    Include copies of any documents that show you were an employee of the business and support your claim, such as paycheck stubs, W-2's, cancelled paychecks, timesheets, time cards/slips and employment agreements/contracts.

  • If you are making less than $7.25 per hour or were not paid overtime, you can contact the federal Department of Labor to file a complaint. An employer cannot retaliate against you for filing a complaint.

    To file a complaint, gather the following information: (1) your name, (2) your address and phone number (how you can be contacted), (3) the name of the company where you work(ed), (4) the location of the company (this may be different from where you worked), (5) the phone number of the company, (6) the manager or owners name (who should we ask to speak to?), (7) the type of work you did, (8) how and when you were paid (e.g., cash or check, every Friday), and (9) any additional information that you can provide such as copies of pay stubs, personal records of hours worked, or other information on your employers pay practices.

WORK CONDITIONS VIOLATIONS

You have the right to report injuries, safety issues, and actions taken against you for speaking up, including being fired, demoted, or disciplined.

If you are working in unsafe conditions, you can file a complaint online, via email, via phone, or in person at your local OSHA office. The federal Department of Labor’s Occupational Safety & Health Administration may be able to help.
